Who is Required to Secure this Bond
An Adoption Facilitator Bond is mandatorily required by the State of California Department of Social Services for all independent business entities that are in the business of matching prospective adoptive parent(s) with birth parent(s) who have decided to place their child for adoption. An Adoption Facilitator’s only legitimate service is to arrange contact between the birth parent and the prospective adoptive parent(s). An Adoption Facilitator is not a licensed Adoption Agency.
Bond Requirement Specifics
The California Adoption Facilitator Bond requirement is set forth in the California Family Code Section 8632.5, to be in favor, and payable to the People of the State of California and is structured to benefit any person or persons damaged by acts made by the Adoption Facilitator characterized by fraud, dishonesty, misstatement, misrepresentation, deceit and or any unlawful acts or omissions by the Adoption Facilitator. The Surety Company who issued the Adoption Facilitator bond on behalf of the Bail Agent must validate each claim and in the event the Bail Agent is found negligent, the Surety Company must pay the damages sought in the bond claim.
Who is protected Under this Bond
Any person or persons for whom the Adoption Facilitator rendered services. The Adoption Facilitator shall account to any person affected, in respect to business done, or transactions occurring under or by virtue of authority granted by any and all Adoption Facilitator
Underwriting Process
The California Adoption Facilitator Bond is underwritten based on a personal credit check of the business owner(s). In the event the personal credit does not meet the minimum threshold for a standard approval, the premium rate may be elevated and/or the requirement of collateral or a co-signer may be set forth in the approval conditions of the bond.
What you Need to do Once you have your Bond
As the original Adoption Facilitator bond must be filed with the State of California, Department of Social Services the original bond will be mailed to the Adoption Facilitator within 24 hours of submitting their application online so long as the bond is approved and the first year term premium is paid. The Adoption Facilitator will need to forward the original bond to the State of California, Department of Social Services for filing. The bond will be placed in regular mail unless the applicant opts to pay the fee associated with overnight delivery during the application process.
