Who is Required to Secure this Bond

Prior to engaging in the business or acting in the capacity of an immigration consultant, each person shall file with the Secretary of State a bond of fifty thousand dollars ($50,000) executed by a corporate surety admitted to do business in the State of California. The total aggregate liability on the bond shall be limited to fifty thousand dollars ($50,000) (Business and Professions Code Section 22443.1). In addition to the bond, all persons applying to be an immigration consultant must pass a background check by the Secretary of State.

The bond is required by the State of California to protect any person damaged by any fraud, misstatement, misrepresentation, unlawful act or omission, or failure to provide the services of the immigration consultant or the agents, representatives, or employees of the immigration consultant while acting within the scope of that employment or agency.

Underwriting Process

Each applicant must first complete and submit the application for a Immigration Consultant Bond, which contains all of the pertinent information regarding the business and business owners. Once the application is received, a routine examination of the business owner’s/applicant’s personal credit history will be performed to determine approval of the bond. Upon receipt of the application, our agency will be able to provide a response as to approval for the Immigration Consultant Bond within one business day. Once the application is approved, the bond will be executed and released to the applicant upon receipt of payment and original application.

What you Need to do Once you have your Bond

Once the Immigration Consultant Bond has been approved and released to the applicant’s care, it must be filed with the Secretary of State, along with all related paperwork. The Secretary of State will maintain the bond, which must remain effective at all times to prevent the revocation of the Immigration Consultant capacity. If for any reason the bond is suspended or canceled, the licensee will receive a cease and desist order from the Secretary of State until the bond is restored.
