Who is Required to Secure this Bond

The bond is required of a plaintiff who requests that writ of attachment (attachment is the act of seizing property to secure a judgment) be placed on the defendant’s property. The bond is required when a sheriff must attach (legally take) the property of the defendant.

Why is the Bond Required

The bond is required to protect the sheriff against all damages, costs, charges and expenses of any nature that may be sustained by the Sheriff in the process of attaching the property. The plaintiff will be held liable for any loss of liability that occurs in the attachment of the property.

Who is Protected Under this Bond

The bond protects the sheriff who will be attaching the property under the writ of attachment on behalf of the plaintiff. The plaintiff indemnifies the sheriff for all damages, costs, expenses, losses or liability that may occur during the attachment.

Underwriting Process

  • Court order indicating required bond amount, plaintiff   names, defendant names and case number.
